Terms & Condition
By booking accommodation online through our website, you agree to the following terms and conditions:
1. Payment
(a) Each booking is deemed as a binding contract for the number of nights and the number of your party subject to these terms and conditions.
(b) Each booking will be 'held’ for a maximum of three (3) working days at no charge before it needs to be paid in full. Your booking is deemed withdrawn if you do not confirm your booking by making the payment following the three -working -day ‘hold’
© For completeness, your booking is only confirmed at the point that we send our notice of confirmation to the email address that you provide.
(c) Last-minute bookings made within seven (7) days of intended stay will require payment in full upon booking.
(d) All payments are to be made into a bank account as nominated by us from time to time. By selecting 'Book Now' I authorize Sunrise BnB to send instructions to the financial institution that issued my card to take payments from my card in accordance with the terms of my agreement with Sunrise BnB.
2. Cancellation Policy
(a) All cancellations must be made at least more than seven (7) days prior to the date of stay.
(b) For cancellations made less than thirty (30) days but more than seven (7) days prior to the date of stay, all monies paid in accordance with clause 1.(b) above are refundable in full.
(c) For cancellations made less than seven (7) days prior you will be charged a 10% fee
(d) Upon valid cancellation, you will be refunded in accordance with this clause 2 to your New Zealand bank account.
(e) If we are not permitted to accommodate you based on official orders in relation to the Covid-19 pandemic, you can cancel your booking free of charge and receive a full refund.
3. Check-In
(a) Sunrise BnB requires Covid 19 My Vaccine Pass on entry. All persons over the age of 12 who enter the property have to provide proof of vaccination.
(b) Each person who enters the property must scan in using the QR tracer display.
(c) The standard check-in time is 3pm on the first day of your booked stay with us.
If you require an earlier check-in please advise us at the time of your booking. We will use our best endeavors to provide you a suitable room at your preferred check-in time although we make no guarantee that a room would be ready.
(d) Please advise your approximate arrival time at the time of your booking.
(e) Photo ID must be produced upon check-in to verify your booking.
4. Check out time
(a) The standard check-out time is 11 am on the last day of your booked stay with us.
(b) Late check-out is at our discretion subject to our daily availability. If you would like a late check-out, please request at the time you check-in.
(c) We reserve our right to charge you a reasonable fee for late check-out.
5. Your obligation and liability
(a) You are solely responsible for your choice of stay and the suitability of our room(s) for your needs.
(b) You are solely responsible for the information you provided when creating your booking and we cannot be held liable for any erroneous or fraudulent information provided by you.
(c) You agree to follow our reasonable instructions in relation to the use of the property and our rules on your use of the property as contained in these terms and conditions. You indemnify us for any loss, damages, proceedings, or actions that we may suffer from your breach of these terms and conditions including our costs of enforcement on a solicitor-client basis.
(d) You agree to be personally liable and indemnify us for any damage (whether intentional or negligent or otherwise) that you and your invitees, agents, contractors and assigns may cause to the property whether by act or omission and will reimburse/compensate us for the cost of making good your damage and any incidental and/or consequential losses including loss of income and opportunity.
6. Limitation of our liability
(a) We shall be under no liability whatsoever for any direct, indirect, consequential loss and/or expenses and/or injury
to you and/or any member of your party and/or any your vehicles and/or possessions, unless proven to be caused by our gross negligence or the gross negligence of our employees whilst acting in the course of employment.
(b) To the maximum extent permissible under the law, we exclude any and all liability and/or warranties whether express, implied, statutory or otherwise relating in any way to our provision of accommodation to you.
(c) Insofar as we may be liable, our maximum liability to you whether in contract, tort (including negligence), equity, under statute or otherwise for any loss, damage or injury is limited to the actual amount that you paid to us as applicable.
(d) Where applicable, nothing in these terms affects any rights that you may have as a consumer under the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.
7. Our policy on your use of our property
(a) Only you and the persons that you disclosed to us at the time of your booking may occupy the room. Unregistered guests are no allowed.
(b) No parties.
(c) You agree to keep the noise to a minimum from 10 pm at night to 6 am the following morning.
(d) We are unable to accommodate children under the age of twelve (12) years. Minors above the age of twelve (12) years must be accompanied by their guardians at all times when they use our property.
(e) You are to respect the privacy of others using the property. You may use your designated room and common area shared with other users including the patio, driveway and garden seating area.
(f) Strictly no smoking in your room or around the patio area. Smoking is allowed only in the garden seating area at the back of the property.
(g) No pets allowed on the property.
8. Privacy
(a) We will only deal with your personal information in accordance with the Privacy Act 2020 and this privacy policy.
(b) For the purposes of facilitating our administration, you authorize us:
i. to request all information we may require about you and you agrees to release such information to the Company;
ii. to collect information about you from any third parties and the you authorise those third parties to release such information to the us;
iii. to hold all information given to us by yourself or any third party; and
iv. to use all your information for any purpose related to facilitating the administration of our business, including for the purpose of assessing your creditworthiness, to any other credit reporting agency for the purpose of debt collection or notifying a default, and for marketing purpose (in which case the Company will seek consent from the Client); and
(c) Your information will be collected, held and used on the condition that it will be held securely at the our offices and it will only be accessible by us, our employees and agents who need access to it for the administration of our business.
9. Intellectual Property
(a) All Intellectual Property on this Website is owned by us, or content suppliers contracted by us. No part of this Website maybe:
i. distributed or copied for any commercial purpose, nor incorporated in any other work or publication (whether in hard copy, electronic or any other form); or
ii. resold, published, copied, reproduced, transmitted or stored (including in any other website or other electronic form) except that you may print, or download to your hard drive, extracts from the Website only for informational and non commercial purposes use;
10. Website Disclaimer
The information provided on this Website is for general guidance only. Users of the information contained on this Website must make their own assessment of the suitability and appropriateness of the our accommodation services for their particular use. Our rooms may differ from actual images shown.
11. Hyperlinking
If you wish to link to any part of this Website, you must obtain our prior written consent. We reserve the right to prohibit links to this Website and you agree to remove or cease any link upon request from us.
12. Third Party Websites
This Website may contain links to third party websites, including but not limited to booking.com, etc. These websites have not been prepared by and are not controlled by us. They are provided for your convenience only, and do not imply that we check, endorse, approve or agree with third party websites and the representations thereon.
13. Miscellaneous
(a) Compliance with Law: You agree that you will at all times comply fully with all relevant laws, ordinances, rules, regulations and orders of all relevant regulatory bodies during your stay with us.
(b) Amendment: We may amend these terms and conditions from time to time at our discretion.
(c) Jurisdiction and Governing Law: The governing law applicable to these terms and conditions and to your stay with us will be the laws of New Zealand and you agree to submit to the jurisdiction of the New Zealand courts.
(d) No assignment: your rights under these terms and conditions (if any) are not transferrable/assignable unless with our prior written consent.
(e) Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, pandemic, fire, flood, drought, storm or other event beyond the reasonable control of either party.
(f) Any failure by us to enforce any of these terms and conditions shall not be treated as a waiver of that provision, nor shall it affect our right to subsequently enforce that provision.
Cancellation Policy
